Terms of Service – Footsteps Space

Summary (not a substitute for the full Terms): By using Footsteps Space products you agree to these Terms and our Privacy Policy. On Footsteps, public stories may be visible to anyone. On Emu, hosts are responsible for guest information they enter or collect; Emu is not a payment processor. Use the Services responsibly.

1) Acceptance of Terms

By accessing or using any Footsteps Space website, mobile application, or subdomain service (“Services”), you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the Services.

2) The Services

2.1 Footsteps

Footsteps is a location-based travel identity platform that lets users create, tag, and share journey stories on a map. Features may include user-generated content, location tagging, public or private story settings, discovery, and social interactions.

2.2 Emu

Emu (emu.footsteps.space) is a web application for hosts of small real-world experiences. Hosts can create experiences, manage guest lists, record contributions and expenses, invite co-hosts, and share guest registration links. Guests must sign in before registering through an invite link (see §4.1 for available methods). Hosts may also manually add walk-in guest records without those individuals creating an account.

2.3 Changes

We may add, change, or remove features across any Service at any time.

3) Eligibility

You must be at least 13 years old (or the age of digital consent in your jurisdiction).
If you are under 18, you must have consent from a parent or legal guardian.
You must have the legal capacity to enter into these Terms.

4) Your Account

4.1 Sign-in methods

Depending on the product, you may create or access an account through Google, Apple Sign In, and/or email and password. Available methods vary by product and may change over time:

Footsteps app: Google, Apple Sign In, and/or email and password.
Emu: Google today; Apple Sign In or email and password may be added later.

If you use email and password, you are responsible for choosing a strong password and keeping it confidential. If you use Google or Apple, you are responsible for the security of that third-party account.

4.2 Account responsibilities

You are responsible for activity on your account.
Provide accurate information and keep it updated (including a valid email if you sign up with email and password).
We may suspend or terminate accounts that violate these Terms or applicable law.
You may download a copy of your data and delete your account through in-app settings where available, or by contacting us (see §13).

5) User Content and License

You retain ownership of content you create or upload (“User Content”). You grant Footsteps Space a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute User Content solely to operate and improve the Services.

Your responsibilities: You must have the rights to post User Content and it must not infringe others’ rights, break the law, or contain harmful material.

5.1 Emu hosting responsibilities

If you use Emu as a host, you are responsible for having a lawful basis to collect and upload guest contact information (including walk-in records you enter manually).
We process and store that information on your behalf to provide the Service.
Co-hosts you invite may view and manage guest contact details for that experience.

5.2 Payments (Emu)

Emu lets hosts record contribution amounts and payment status for bookkeeping. Footsteps Space is not a payment processor, bank, escrow service, or financial institution. We do not process card payments or hold funds on your behalf.

6) Location (Footsteps app)

This section applies to the Footsteps mobile app. Public stories with location tags may be visible globally and indexed by search engines. On Emu, hosts may share venue or maps information with guests; Emu does not collect device GPS for story-style location tagging.

7) Prohibited Uses

Illegal activity or violation of any law;
Harassment, abuse, or harm to others;
Uploading others’ personal data without permission;
Automated scraping or bulk extraction without written consent;
Reverse engineering or disrupting the Services;
Spam or unauthorized advertising.

8) Our Intellectual Property

The Footsteps and Emu names, logos, product design, and code are protected by intellectual property laws. You may not use our marks without prior written consent.

9) Third-Party Services

The Services integrate with third parties (for example, Google and Apple for sign-in, cloud hosting and authentication providers, and analytics). Your use of those services is subject to their terms. We are not responsible for third-party services.

10) Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind.
We do not warrant uninterrupted, secure, or error-free operation.
You assume risk for your use and interactions with other users.

11) Limitation of Liability

To the maximum extent permitted by law, Footsteps Space shall not be liable for indirect, incidental, special, consequential, or punitive damages.

Our total aggregate liability shall not exceed INR 1,000 or the amount you paid us in the twelve (12) months before the claim, whichever is greater.

12) Indemnity

You agree to indemnify Footsteps Space against claims arising from your User Content, your use of the Services, or your violation of these Terms or applicable law.

13) Suspension, Termination, and Account Deletion

We may suspend or terminate access for violations of these Terms or applicable law.
Footsteps app: delete your account in app settings or contact us.
Emu hosts: account deletion may be unavailable while you host active upcoming published experiences.
Emu guests: you may delete your account in Account settings; this removes registrations linked to your account.

14) Changes to the Services or Terms

We may modify the Services or these Terms. Material changes will be posted here with an updated date and, where appropriate, notified in-app or by email. Continued use after changes take effect constitutes acceptance.

15) Privacy

Your use of the Services is governed by our Privacy Policy, including your rights under the DPDP Act, GDPR, and CCPA/CPRA where applicable.

16) Governing Law and Jurisdiction

These Terms are governed by the laws of India. Courts in Hyderabad, Telangana, India have exclusive jurisdiction, subject to mandatory consumer protections in your jurisdiction.
